SeekOut – Candidate Privacy Policy | Last Updated: 05/30/2025

SeekOut provides a talent sourcing and recruiting service called SeekOut Spot that sources and recruits qualified candidates for open jobs at prospective employers. We also provide career tools such as CareerSpot that allow candidates to explore opportunities and manage their professional profiles. This Candidate Privacy Policy explains how ZipStorm, Inc., the provider of the SeekOut services (“SeekOut,” “we,” “our,” or “us”) collects, uses, and shares personal information about candidates who are contacted by or interact with SeekOut Spot or our career tools, and how you can exercise your privacy rights.

1. Personal Information We Collect

The personal information we collect depends on how you interact with SeekOut Spot and our career tools.

Information You Provide to Us

When you interact with SeekOut Spot or our career tools, you may provide personal information to us, including:

  • Your name, email address, and phone number;

  • Your resume or CV;

  • Your work history, including job titles, employers, dates of employment, and job descriptions;

  • Your education history, including schools attended, degrees earned, and dates of attendance;

  • Your skills, certifications, and professional qualifications; and

  • Any other information you choose to provide to us.

Information from Other Sources

We may also collect personal information about you from other sources, including:

  • Publicly Available Professional Information: We may collect information from publicly available sources, such as professional networking sites, personal websites, and other publicly accessible online profiles. This may include your name, contact information, work history, education, skills, and other professional information.

  • Employer Data: If you are a candidate for a role with one of our prospective employer customers, that employer may provide us with information about you, including your name, contact information, resume, and other application materials.

Recorded Meetings and Interviews

We may ask to record meetings or interviews with you. If we intend to record a call or video meeting, you will be notified in the meeting invite; through a notification from the third-party technology provider; and/or at the beginning of the call or video meeting. If you accept the invite, we will consider this your consent to being recorded. If you do not want your visual to be recorded, you have the option to switch off your camera. If you do not want your audio to be recorded, please decline the meeting invite. If you accept the meeting and subsequently change your mind, you have the option to withdraw your consent by declining the meeting before it commences.

Information Collected Automatically

When you use our career tools or interact with our online services, we may automatically collect personal information from your device, including:

  • Cookies and Similar Technologies: We use cookies, web beacons, and similar technologies to collect information about your browsing activity, preferences, and interactions with our services.

  • IP Address: We collect your IP address, which may be used to determine your approximate location.

  • Device Information: We collect information about the device you use to access our services, including hardware model, operating system and version, unique device identifiers, and mobile network information.

Information Collected About Children

We do not knowingly collect any personal information from children under the age of 18. Our services are intended for individuals who are at least 18 years old. If we discover we have received any personal information from a child under the age of 18, we will take reasonable steps to delete that information as quickly as possible. 2. Use of Personal Information

We use the personal information we collect about candidates for the following purposes:

  • Evaluate Qualifications: We use your personal information to evaluate your qualifications and suitability for job opportunities with prospective employers.

  • Match to Opportunities: We use your personal information to match you with relevant job opportunities based on your skills, experience, and preferences.

  • Communicate About Roles: We use your contact information to communicate with you about potential job opportunities, interview scheduling, and other recruitment-related matters.

  • Improve Services: We use your personal information to improve and enhance our talent sourcing and recruiting services, career tools, and overall candidate experience.

  • Comply with Law: We use your personal information to comply with applicable legal requirements, respond to legal process, and exercise or defend legal claims.

  • Prevent Fraud: We use your personal information to detect, investigate, and prevent fraudulent or unauthorized activity and to protect the rights and property of SeekOut, our customers, and others.

3. Disclosures of Personal Information

The personal information we collect about you may be disclosed as described below.

Prospective Employers

If we identify you as a potential match for a job opportunity with a prospective employer who uses SeekOut Spot, we may share your personal information with that employer. This may include your name, contact information, resume, work history, education, skills, and other information relevant to the job opportunity. The prospective employer’s use of your personal information is subject to their own privacy policy.

Service Providers

We may share your personal information with our third-party service providers that work on behalf of SeekOut to support our talent sourcing and recruiting activities. These service providers act on our behalf and are authorized to use your personal information only as necessary to provide services to us. Examples include cloud hosting providers, communication platforms, analytics providers, and background check providers.

Other Disclosures

We may also disclose your personal information: (i) in connection with, or during negotiations of, any merger, sale of SeekOut assets, financing, or acquisition of all or a portion of our business; (ii) in response to a request from a competent law enforcement body, regulator, government agency, or court; (iii) to exercise, establish, or defend our legal rights; or (iv) with your consent or at your direction.

4. International Data Transfers

In providing our services, we may transfer personal information from international jurisdictions, including from the European Economic Area (EEA), to the United States. As a result, your personal information may be transferred to and processed in countries other than the country in which you are resident. These countries may have data protection laws that are different from the laws of your country.

We implement appropriate safeguards to protect your personal information in accordance with applicable law. We comply with our obligations under data processing agreements, including applicable Standard Contractual Clauses (SCCs), to ensure that your personal information is adequately protected when transferred internationally.

5. Data Retention

We retain your personal information for as long as reasonably necessary for the purposes described in this Candidate Privacy Policy, while we have a legitimate business need to do so, or as required by law. When we have no ongoing legitimate business need to process your personal information, we will delete it or, if this is not possible, securely store it and isolate it from further processing until deletion is possible.

We may retain cached or archived copies of your personal information for up to two (2) months. We refresh and update candidate information on a regular basis to ensure accuracy.

6. Third Party Websites

Our services may include links to third-party websites, services, and applications that are not owned or operated by SeekOut. This Candidate Privacy Policy does not apply to those websites, services, or applications, which may have their own privacy policies or notices. SeekOut is not responsible for the content or privacy practices of any linked websites, services, or applications that are operated by third parties. We encourage you to review the privacy policies of any third-party sites you visit.

7. Your Rights and Choices

Depending on where you reside, you may have the following privacy rights related to the personal information we collect:

Right to Know: You may request that we disclose what personal information we have collected, used, disclosed, sold, or shared about you, and how it is used and disclosed.

Right to Data Portability: You are entitled to receive your personal information in a structured, commonly used, and machine-readable format, and you have the right to transfer this information to another data controller.

Right to Delete: You can request that we delete the personal information we have collected from you (with some exceptions) and request that our service providers do the same.

Non-Discrimination: You have the right not to receive discriminatory treatment for the exercise of your privacy rights under applicable law.

Right to Correct: You can request we correct the inaccurate personal information that we have about you.

Right to Restrict Processing: You can request that we restrict the processing of your personal information.

Right to Object: You can object to the processing of your personal information on certain grounds.

Right to Opt-Out of Sale/Sharing: You can opt out of the “sale,” “share,” or use of your personal information for targeted advertising.

Right to Stop Sharing: You can request that we stop sharing your personal information with third parties for cross-context behavioral advertising purposes.

If you wish to exercise any of these privacy rights, please submit a request via the Privacy Choices Portal or via email at [email protected]. You may also exercise your right to opt out of sales, sharing, or targeted advertising by visiting our services with a legally recognized opt-out preference signal enabled, such as the Global Privacy Control.

In order to protect your personal information from unauthorized access or deletion, we may require you to verify your identity before we can process a privacy request. If we cannot verify your identity, we may be unable to comply with your request.

8. Additional Information for Individuals in Certain U.S. States

This section provides additional information for residents of California, Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah, and Virginia relating to their privacy rights under the consumer privacy laws enacted in those states (“State Laws”). If you are a resident of one of these states, this section applies to you.

This Candidate Privacy Policy describes the categories of personal information we have collected, disclosed for a business purpose, or sold. Please refer to the sections above to see specifically what personal information is collected about you and how and to whom we disclose that personal information.

Sensitive Personal Information

If you provide sensitive personal information during the recruitment process, such as your race, ethnicity, or other demographic information, we collect this information solely for the purpose of complying with legal and regulatory requirements and to support diversity, equity, and inclusion programs.

Texas Residents

The entity maintaining this website is a data broker under Texas law. To conduct business in Texas, a data broker must register with the Texas Secretary of State (Texas SOS). Information about data broker registrants is available on the Texas SOS website.

Authorized Agents

If you are an authorized agent seeking to make a request on behalf of a consumer, please submit your request via the Privacy Choices Portal. You will be required to upload documentation showing proof of written permission from the individual authorizing you to submit a request on their behalf. We reserve the right to require the individual to confirm their request and/or identity.

Appeals

If we deny your request, you may appeal our decision by contacting us at [email protected]. If you have concerns about the result of an appeal, you may contact the attorney general in the state where you reside.

9. Additional Information for Individuals in Europe

If you are located in the European Economic Area (“EEA”), the United Kingdom, or Switzerland, the following section applies to you.

Legal Basis for Processing

When we process your personal data as described in this Candidate Privacy Policy, we do so in reliance on the following lawful bases:

  • Legitimate Interests: We process your personal data when we have a legitimate interest in doing so, such as to provide our talent sourcing and recruiting services, to match candidates with job opportunities, and to improve our services. We balance our legitimate interests against your rights and interests and do not process your data where our interests are overridden by your rights.

  • Consent: In some cases, we may process your personal data based on your consent, such as when you opt in to receive communications from us or agree to a recorded interview. When consent is the legal basis for our processing, you may withdraw your consent at any time. This will not affect the lawfulness of processing before your withdrawal.

  • Contractual Necessity: We may process your personal data where it is necessary for the performance of a contract with you or to take steps at your request prior to entering into a contract.

  • Legal Obligation: We may process your personal data where it is necessary for compliance with a legal obligation to which we are subject.

Data Subject Rights

In addition to the rights described in Section 7 above, individuals in the EEA, UK, and Switzerland have the right to lodge a complaint with a data protection authority about our collection and use of your personal information. For residents of the United States, SeekOut is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC).

We may update this Candidate Privacy Policy from time to time. When we update this policy, we will take appropriate measures to inform you, consistent with the significance of the changes we make. If we make material changes, we will provide you with proportional notice of the changes.
